Terms of Usage for GateCentral Network & User's agreement

Use of and participation in GateCentral-Community depends upon your acceptance of the following terms and rules. If you choose to take part (e.g. write news or messages to others, play at our GamesPortal, .. etc.) you acknowledge your acceptance of these terms. Whenever we mention 'user' it is you who is meant. We are GateCentral.

1. Nickname
   With registering an account at our GatePortal-site you choose a nickname. It will be used to identify yourself whenever you appear in the community. Please feel free to create a name which suits you well. With one exception: you may not use a nickname (or e-mail address) that attempts to impersonate another person - the law and the copyright are clear in this point - belongs to another person or violates the copyright of real persons or companies.
   
   
2. Guidelines for usage
   Our Portal is for Infotainment-purposes. We serve news, contact to others and a place to play games. Please read the following points and try to follow them as close as possible. We try not to ask impossible things but some things have to be clarified though. And you will see for yourself that most of the guidelines are easily observed.
   • Please respect others and do not make a fool of yourself.
   • Do not attack other users personally. Not in a posting at our news-board and not during a game. Life is to hard anyway .. here are just games. So please take it easy.
   • Please help us to improve this Portal. This part of the WWW - our Portal - tries to bring you fun and entertainment. We would be happy if you could spare some time to help us. How? Be active. Play, write news, send us infos and hints, communicate and spread the word of our Portal.
   • It is not allowed to 'post' advertisements, services or any other things not related to our GamesPortal. 'post' is meant in the way of writing news, game chat-infos or news on our boards. If you think it could be interesting for us please give us a word and we will take a look.
   • Please head the privacy of others. Do not spread private data (like phone numbers, icq, .. etc.) from others. This could lead to problems and - as we stated earlier - do not wand troubles in here.
   • Trolling is prohibited. The word Troll comes from newsgroups and means someone who is visible trying to destroy the community with foul language, never ending tirades and bitter words. We are going to handle this as soon as we detect such behaviour.
   • Posting the details of bugs in our software is prohibited. Please send us the infos and we try to remove the bugs as it is important for the other users too.
   • We do not want the following contents in our Portal: pornography, racist or otherwise discriminating messages, threats to cause physical and/or mental harm, language that is offensive to other users andmaterial that breaks any law. We are going to handle this as soon as we detect such behaviour.
   • There are postings and news that may basically be not suitable for the forum or newsboard. We call them off-topic-postings (OTP). We decided not to prohibit them but please don't make exzessive use of it. Other users may not like it and this could be the start of unrest.
   • Our Admins are visible through the Asterix * before their names. They have the right to act in the name of GateCentral as far as they do not violate the Terms of Usage. They are out to help you, clearify things and sometimes decide whether something is allowed or not.
   • We would like to thank you that you visited our Portal or even decided to stay a little longer. Please feel free to contact us if you have any comments, questions or suggestions. You could reach us via our Comm-Center or directly via eMail.

    

3. Messages & News written by you
   This is the stuff all webpages use whenever receiving creative material from users. It is there to protect us against problems with laws and copyright-issues.
   Users hereby waives any and all rights to ideas, news, textbased infos, graphic data and other creative "submissions" sent to the GateCentral-team. The user authorizes GateCentral to utilize, in any manner we see fit and for eternity (how long it may be), the info sent to the site, which shall become the property of GateCentral. The user releases GateCentral from any and all claims or liability (all the known now and all which may arise in the future) in connection therewith, and gives his/her agreement to indemnify GateCentral in connection therewith. The user agrees and acknowledges that participation in the GateCentral site is not going to give a rise to any confidential, fiduciary, contractual, implied-in-law, implied-in-fact or other relationship of any sort between the user and GateCentral (others then are obvious through reading this Terms of Usage).

4. Disclaimer of liability
   GateCentral sees itself as a Portal to the WWW and there to some special places. We gather informations and news and bring them to you. We only distribute them and do not publish news & informations. The contents is provided by users and companies which are not part of this website. GateCentral shall not be responsible for supervising, policing, monitoring, or editing such informations & news, exercises no more editorial control over such content than would a bookstore, public library, newsstand, or distributor of content in any other way. Accordingly, GateCentral shall not be responsible for exercising editorial control over such content. However there may be informations which are given by GateCentral-Admins (visible through the asterix *). Notwithstanding the foregoing, GateCentral shall have the right, but not the obligation, to view and monitor such content in order to ask, respond to or comment upon communications by users and in order to determine compliance with the foregoing Terms of Usage. GateCentral shall have the right and sole discretion to change, edit, refuse, port or to remove any content or informations whatsoever which it finds to be in violation of the terms hereof.
   
   It is vitable that users express their opinion on our boards and in the chat-rooms. Nevertheless it is not necessarily the opinion of GateCentral (it even may be the contrary). GateCentral is not responsible for any Submissions provided by users which may be harmful or offensive to others. GateCentral is also not responsible for the content of any site linked to and from the GateCentral-Network. We express our distance to any site which is not part of the GateCentral-domain.
   
   

5. Participant's indemnification / Obligations
   The user agrees to defend, indemnify and hold harmless GateCentral, its parent, subsidiary/affiliated companies, their officers, respective directors, employees and agents from and against all claims, costs, losses, and expenses (including attorneys fees) arising out of user's use of the GateCentral-Network, or arising out of any violation of these Terms of Usage by users including, without limitation, any communication by users which is claimed to be obscene, defamatory, or otherwise unlawful, which is claimed to violate the trademark, copyright, proprietary or other rights of third parties, or which constitutes a submission of materials.

6. Termination
   GateCentral shall have the right to immediately and without discussion terminate any users use of the GateCentral-Network if we determine in its sole discretion that users has violated the Terms of Usaget set forth herein or otherwise breached this agreement. This implies too that the user has engaged in conduct which GateCentral determines in its sole discretion to be unacceptable.
